1. Agreement to Terms
These Terms of Service (“Terms”) govern your access to and use of the website located at www.thepruittteam.com (the “Site”), operated by The Pruitt Team, a division of West USA Realty, Inc. (“we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
2. About Us
The Pruitt Team provides residential real estate brokerage and property management services in the Phoenix, Arizona metropolitan area under West USA Realty, Inc., a licensed Arizona real estate brokerage. Real estate and property management services are regulated by the Arizona Department of Real Estate (ADRE).
3. Use of the Site
You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Site in any way that violates applicable federal, state, or local law or regulation;
- Attempt to gain unauthorized access to any portion of the Site, its servers, or connected systems;
- Use any automated means to access, scrape, or collect data from the Site without our prior written consent;
- Interfere with or disrupt the operation of the Site or the servers or networks used to make it available;
- Transmit any harmful code, malware, or other disruptive material.
4. No Professional or Contractual Relationship
Information provided on the Site is for general informational purposes only and does not constitute real estate, legal, financial, or tax advice. Use of the Site does not create a brokerage, agency, client, or fiduciary relationship between you and The Pruitt Team or West USA Realty, Inc. Any such relationship is established only through a separate written agreement signed by both parties.

Property listings, availability, pricing, rental rates, and related details displayed on the Site are subject to change without notice and may not reflect real-time availability. We make no guarantee regarding the accuracy or completeness of any listing information, which may be provided by third parties, including multiple listing services (MLS). All properties are subject to prior sale, lease, or withdrawal from the market.
6. Fair Housing
The Pruitt Team and West USA Realty, Inc. are committed to compliance with the Federal Fair Housing Act and the Arizona Fair Housing Act. We do not discriminate on the basis of race, color, religion, sex, national origin, familial status, disability, or any other protected class.
7. Intellectual Property
All content on the Site, including text, graphics, logos, images, branding, and software, is the property of The Pruitt Team, West USA Realty, Inc., or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written permission.

To the fullest extent permitted by law, The Pruitt Team, West USA Realty, Inc., and their affiliates, agents, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Site.
11. Indemnification
You agree to indemnify and hold harmless The Pruitt Team, West USA Realty, Inc., and their affiliates, agents, and employees from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Site or your violation of these Terms.
12. Dispute Resolution and Binding Arbitration
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and to have a jury trial.
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site (a “Dispute”) shall first be addressed through good-faith negotiation between the parties. If the Dispute cannot be resolved through negotiation, it shall be resolved by final and binding arbitration rather than in court, except as otherwise provided below.
The arbitration shall be administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules, and shall take place in Maricopa County, Arizona. The arbitration shall be conducted by a single arbitrator, and judgment on the award rendered may be entered in any court having jurisdiction. This agreement to arbitrate is governed by the Federal Arbitration Act.
Waiver of Class Actions. You and we agree that any Dispute shall be brought in an individual capacity only, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.
Exceptions. Nothing in this section prevents either party from (a) seeking injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property or confidential information, or (b) bringing an individual claim in small claims court. Nothing in this section limits any right or remedy that cannot be waived under applicable Arizona law, including obligations governed by the Arizona Department of Real Estate or the Arizona Residential Landlord and Tenant Act.
Opt-Out. You may opt out of this arbitration provision by sending written notice to us within thirty (30) days of first accepting these Terms, at the contact information provided below. If you opt out, neither party will be bound by the arbitration and class-action waiver provisions of this section.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict-of-law principles. Subject to the arbitration provisions above, any dispute not subject to arbitration shall be resolved in the state and federal courts located in Maricopa County, Arizona.
14. Changes to These Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised “Last Updated” date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
